Kramer Levin Secures $23.4M Patent Infringement Verdict on Behalf of Acceleration Bay

Kramer Levin obtained a patent infringement verdict on behalf of Acceleration Bay, a technology incubator, against video game giant Activision, now a subsidiary of Microsoft. Acceleration Bay filed suit in 2015, asserting pioneering patents related to advanced networking and broadcasting technology that enabled key multiplayer functionality in Activision’s blockbuster Call of Duty and World of Warcraft games.

The Honorable William Bryson of the Federal Circuit, sitting by designation, presided over the trial. After a one-week trial, the jury found that Activision infringed Acceleration Bay’s two asserted patents and awarded $23.4 million in damages. According to a Kramer Levin spokesperson, the team was “thrilled to get this case to trial after nine years, and it was gratifying for Acceleration Bay to finally have had its day in court.”
