Rafael is a senior associate (Australia) in our London dispute resolution team, specialising in complex commercial litigation with a particular interest in technology, engineering, and crypto/blockchain disputes.

Rafael is a litigator with experience acting in significant commercial disputes with high financial and reputational exposure, as well as advisory and regulatory matters. He specialises in commercial litigation, particularly collective proceedings and class actions, many with significant cross-border elements. He has a particular focus on technology, engineering, and crypto/blockchain disputes.

  • Marsh/JLT Insurance, defending at trial a complex class action (against a global insurance and risk company) concerning local government mutual insurance in the Supreme Court of New South Wales
  • Mercedes-Benz in relation to a class action brought in respect of approximately 330,000 vehicles alleging the use of "prohibited defeat devices" in diesel vehicles
  • a leading global digital asset exchange in relation to a successful strike out / summary judgment of a claim litigating novel issues around the duties the industry owes to third parties
  • AMP shareholder class action proceedings arising out of evidence given at the Banking Royal Commission
  • a high-profile logistics and supply chain dispute, including strategic contract renegotiation, complex damages claims, operational restructuring, industrial relations issues and litigation risk management
  • a leading global digital asset exchange on profile cryptocurrency fraud and asset recovery disputes, including tracing claims, disclosure orders, cross-border recovery strategies, regulatory risk and exchange liability issues
  • a life reinsurance and insurance holding company on various corporate advisory matters

Background

Rafael is admitted to practice in the Supreme Court of NSW and High Court of Australia. He holds a Bachelor of Laws with First Class Honours and Bachelor of Engineering (Mechatronics) with First Class Honours from the University of New South Wales.
