As an update to our previous client alert regarding birthright citizenship, on July 23, 2025, the U.S. Court of Appeals for the Ninth Circuit ruled that President Trump’s executive order restricting birthright citizenship violated the 14th Amendment’s grant of citizenship to “all persons born in the United States and subject to the jurisdiction thereof.” Accordingly, the nationwide injunction on restrictions to birthright citizenship remains in effect.
We will keep you updated on any subsequent litigation on this issue and any changes to birthright citizenship.
