The LCAM-HSF survey on costs in mediation in arbitration deadline for responses has been extended until 6 September 2024. The extension will enable those keen to provide responses the opportunity to do so over the course of the summer break and early September. The survey welcomes responses from those with experience of either (or both) of these dispute resolution processes, including arbitrators, mediators, in-house counsel, private practitioners, and end users.

The snapshot survey seeks to explore users' experiences of various costs-related issues in both dispute resolution processes, such as recoverability, whether interest is awarded on costs, and how settlement affects costs. The survey also seeks to explore the potential costs differences between institutional and ad hoc arbitration and the potential impact of the amount in dispute.

The costs of arbitral proceedings is a perennial hot topic among the international arbitration community, while mediation and other forms of ADR often seen by parties and their advisers as a means of reducing the costs involved in resolving their dispute. The snapshot survey therefore provides a unique opportunity to gain insights into the costs issues that matter most to commercial parties.
