The European Court of Human Rights (ECtHR) has, for the first time, found a violation of rights under the European Convention on Human Rights in the climate change context and outlined positive obligations on all States, including the UK, in relation to measures to mitigate climate change. This decision marks a significant development in the approach of the ECtHR and how the Convention can be used in climate change litigation going forwards.
