Getty has largely lost its case against Stability AI, losing both the claims of secondary copyright infringement via importation of an article which is an infringing copy into the UK and the claim of possessing or dealing with an article which is an infringing copy – with some very limited success on its trade mark infringement claims: Getty Images (US) Inc and others v Stability AI Limited [2025] EWHC 2863 (Ch).
For a brief summary of the court's findings, see this post on our Intellectual Property Notes blog.
Note: Permission to appeal has been granted in respect of the secondary copyright decision, see this post on our Intellectual Property Notes blog.
