Matthew is a commercial litigator with a focus on class actions.

Matthew has extensive experience advising a wide range of corporate clients in complex commercial disputes across the firm’s Melbourne, Sydney and London offices. He has a focus on class actions.

Matthew’s recent matters have included significant class actions in relation to financial services, product liability and mass tort. He also has extensive general commercial litigation experience, including in relation to energy and breach of warranty disputes (including acting for joint venturers, shareholders and acquirers). He works with clients across a range of sectors, with a particular focus on the banking/financial services and consumer sectors.

Matthew’s experience includes advising:

  • The State of Victoria in defending class actions for alleged economic loss arising from hotel quarantine and COVID-19 restrictions across the State of Victoria
  • Mercedes-Benz in defending product liability class action proceedings relating to diesel emissions
  • Ansell in defending shareholder class action proceedings
  • E&P Financial Group in defending class actions on behalf of clients of Dixon Advisory, a subsidiary of E&P, relating to allegedly improper financial advice
  • The shareholders of Optal in an expedited claim in the English Commercial Court relating to the sale of the business where the buyer sought to rely on the SARS-CoV-2 pandemic to avoid completing the sale
  • AusNet Services in defending relation to two bushfire class actions in Victoria, Australia
  • An international oil major on a claim for more than US$1 billion relating to an oil and gas project in the Arctic circle. The case was brought in the High Court in London and included very significant claims for lost profits relating to an allegedly lost opportunity to develop a new gas transportation technology
  • Metcash in its successful defence of injunction proceedings brought by the Australian Competition & Consumer Commission seeking to block the company’s acquisition of a rival supermarket business

Background

Matthew holds a Bachelor of Laws (First Class Honours) and Bachelor of Commerce from Monash University, and was awarded the Supreme Court of Victoria Prize for Best Honours Student. He also holds a Master of Law (Class I) from the University of Cambridge. 

Matthew is a solicitor of the Supreme Court of Victoria and is admitted to practice in Australian federal courts. He has also served as an Associate to the Honourable Justice K M Hayne AC of the High Court of Australia.
