Following on from our recent publications "Navigating through to the end of legacy PFI" and "New IPA guidance on PFI projects", we have produced a third quick reference guide taking a closer look at the six key challenges we have recently dealt with in managing disputes at the SPV/ProjectCo level for PFI projects.
In particular, we consider issues such as the provision of information to funders, insulating investors, disputes under the Project Agreement, events of default, director duties and administration risks. These challenges will be relevant to privately funded entities investing in infrastructure and energy projects, particularly with government initiatives.
