Kiera MacWhinnie
Kiera supports both prelitigation patent disputes and active litigation involving patent owners seeking to protect core assets and companies defending against competitor lawsuits and allegations of infringement. She contributes to the development of technical case strategies, including infringement analyses, risk and appropriation assessments, and validity reviews. She also assists with the preparation of pleadings, Rule 11 motions and other federal court filings.
As part of the firm’s monthly IP learning series, Kiera recently presented on significant developments in the patent damages landscape, highlighting recent record-breaking awards, key Federal Circuit decisions addressing expert testimony and apportionment, such as EcoFactor v Google, and evolving approaches and future implications in the district court’s gatekeeping standard.
Kiera actively participates in the firm’s pro bono program. Her recent pro bono representations include helping veterans file benefits claims for their service-related disabilities with the Department of Veterans Affairs and helping children file for Special Immigrant Juvenile Status through family and immigration courts.
Kiera returned to the Silicon Valley office after participating in the firm’s summer associate program in 2024. During law school, she served as a federal judicial extern with the Honorable Michael A. Shipp in the District of New Jersey.
