Sabah handles many of her cases from inception to resolution, crafting initial strategies and architecture to meet clients’ commercial objectives, developing claim construction, drafting pleadings and other court filings, and handling motions and hearings.

Sabah Khokhar litigates patent disputes involving core assets and technology-driven innovations. 

Sabah represents clients in rapidly evolving sectors, including telecommunications, cybersecurity, computer software, hardware and networking, electronics and medical devices, in complex patent infringement actions in federal district courts and in proceedings before the International Trade Commission (ITC). 

She manages and oversees large-scale document discovery, takes and defends depositions, and, as the most senior associate on many matters, handles day-to-day case management and communications with clients, colleagues and counsel. She works closely with technical experts to develop infringement, validity and damages positions. A core member of litigation teams, Sabah briefs pretrial dispositive and case-defining evidentiary motions and supports trial preparation, trial and post-trial advocacy. She is also frequently brought into ongoing cases to address patent infringement and validity issues and challenges that arise. 

Sabah’s first experience in intellectual property and patent law was as a summer legal intern with a multinational software company that specializes in business and personal financial software. Although her role was not originally IP focused, Sabah spent significant time supporting in-house counsel with IP-related matters, including assisting with patent prosecutions and drafting responses in United States Patent and Trademark Office actions and matters before the Patent Trial and Appeal Board, sparking her interest in patent law and litigation, which she built on throughout the rest of her legal studies. 

While her work on behalf of clients spans a variety of technologies, Sabah has developed a particular interest in artificial intelligence. An enthusiastic learner and writer, she helps develop the firm’s client insight publications covering noteworthy developments in AI regulation and litigation. 

In addition to her patent work, Sabah is committed to pro bono representation, including bringing mandamus proceedings to compel adjudication of immigration petitions and the issuance of visas in asylum cases, assisting clients in asylum application proceedings and participating in legal clinics with Volunteer Lawyers for the Arts, advising artists and creative businesses on IP matters. 

Sabah is a member of the firm’s Attorneys of Color Affinity Group and the Women’s Initiative.
