Experts from across Herbert Smith Freehills Kramer's Global Competition Litigation practice will discuss the key trends that are currently emerging in competition class actions across the US, the UK and EMEA, outline what is on the horizon in their regimes, and give you the practical insights you need to minimise the risk to your business and maximise your ability to defend a claim successfully. Private enforcement of competition law has a long history in the US where it has been an essential part of the competition enforcement toolkit. In recent years, legal reforms throughout the UK and Europe have made competition law claims a major risk for business on both sides of the Atlantic. This shows no signs of slowing with continued investment in Europe by litigation funders and specialist litigation boutiques and continued efforts by legislators and policy makers to encourage claims. We will explore how this has changed the competition enforcement landscape, how private and public enforcement interact and what this means for businesses in practice. We will also look ahead to how regimes will evolve in the coming years with a particular eye on:

  • the UK government’s proposals to deliver swifter and simpler competition redress, including through a more exacting certification standard
  • the Digital Markets Act as a driver of competition litigation in Europe and the landmark decision by the German Federal Court of Justice on the bundling of cartel damages claims
  • how an ostensibly minor procedural rule, the State Antitrust Enforcement Venue Act of 2022, can now force defendants to fight a three-front battle against federal enforcers, state attorneys general, and private litigants
