Paul Apáthy
Paul leads the firm’s restructuring and insolvency practice in Australia.
Paul is a highly experienced restructuring, insolvency and special situations lawyer. He advises corporates, financiers, private capital funds and insolvency practitioners in respect of financial restructurings, insolvencies, security enforcement and distressed acquisitions, and has had advised debtors and creditors of many of Australia’s largest and most complex restructurings and insolvencies over the last decade.
Paul has been regarded widely recognised as one of Australia’s leading restructuring practitioners, including by Best Lawyers (Leading Lawyer), Chambers Asia Pacific (Band 2), Legal500 (Leading Partner) and Lexology (Recommended). He is also a Director of the Turnaround Management Association of Australia and a fellow of INSOL International (Honours).
Paul has extensive experience advising stakeholders in respect of corporate distressed situations including:
- companies and corporate groups (including their boards and shareholders/sponsors)
- financiers, including private credit funds, banks and noteholders
- acquirers and distressed investors

Selected matters
- advising Australian oncology group GenesisCare on the restructuring of its US$2 billion debt facilities under chapter 11 of the US Bankruptcy Code
- advising the ad hoc noteholder group on the restructuring and upsizing of Infrabuild’s US$550 million secured notes
- advising Allegro Funds on its successful acquisition of the stressed Global Express division of Toll Group
- advising the senior creditor and FTI as receivers of Altus Renewables in respect of the receivership, including the sale of the business to Albioma SAS
- advising the senior lenders on the restructuring of BIS Industries’ A$1.3 billion debt facilities and their acquisition of the group by way of creditors’ schemes of arrangement
- advising Speedcast on the restructuring of its US$634 million debt facilities under chapter 11 of the US Bankruptcy Code (the first time a major Australian listed company filed for chapter 11)
- advising the senior lenders to RCR Tomlinson on its voluntary administration and liquidation, including in respect of the Re RCR Tomlinson Ltd [2020] NSWSC 735 case dealing with priority to WIP
Background
Originally from New Zealand, Paul practised in London for a number of years for several international firms before joining Herbert Smith Freehills Kramer in Sydney. He is qualified in New South Wales, England & Wales and New Zealand.
