Pénélope Agosta
Pénélope Agosta is an associate, in the Competition team of Herbert Smith Freehills Kramer Paris.
She focuses her practice on French and EU antitrust litigation and competition law, representing clients before both EU and French authorities and courts. Her work spans behavioural investigations (including cartels, abuse of dominance, and other restrictive agreements) as well as merger control, with experience across a broad range of sectors, including tech industry, life sciences, defence, and consumer products. She has also developed strong expertise in procedural issues arising in competition investigations, particularly with respect to the protection of companies’ rights of defence during investigations conducted by the French Competition Authority and the European Commission.

- acting for a global medical device manufacturer in a cartel investigation initiated by the French Competition Authority and in the related appeal challenging the Authority’s dawn raids*
- supporting a global animal health company in a complaint before the European Commission regarding a potential killer acquisition*
- representing a French defence company on its acquisition by two major international defence industry players before the European Commission*
- representing a global food‑packaging manufacturer in a cartel investigation before the French Competition Authority and in the subsequent appeal before the Paris Court of Appeal*
