Dr. Patricia Nacimiento

Patricia Nacimiento ist auf Rechtsstreitigkeiten spezialisiert und hat einen besonderen Schwerpunkt in der Schiedsgerichtsbarkeit und der alternativen Streitbeilegung, einschließlich Mediation. Sie verfügt über große Erfahrungen sowohl als Parteivertreterin als auch als Schiedsrichterin. Sie verfügt zudem über beträchtliche Kenntnisse in grenzüberschreitenden Rechtsstreitigkeiten und Gerichtsverfahren mit Schiedsbezug. Ihre fachlichen Schwerpunkte liegen im Energie- und Baurecht sowie bei post-M&A Streitigkeiten. Patricia Nacimiento hat umfangreiche Erfahrung bei der strategischen Leitung von Großverfahren und der Führung grenzüberschreitender Teams. Dazu gehört auch die Aufklärung und Bekämpfung von Korruption und Geldwäsche.

Ein weiterer Schwerpunkt liegt in der Investitionsschiedsgerichtsbarkeit und dem Völkerrecht, auch mit Erfahrungen im Bereich Wirtschaft und Menschenrechte. 

Als Parteivertreterin und Schiedsrichterin hat Patricia Nacimiento weltweit über 140 Schiedsverfahren nach den Regeln zahlreicher Schiedsinstitutionen durchgeführt - darunter ICC, ICSID, SCC, CIETAC, DIS, LCIA, ICDR, Schweizerische Handelskammer, Indian Council of Arbitration und die Dänische Institution der Schiedsverfahren sowie Ad-hoc-Verfahren. Sie wird auch regelmäßig als Schiedsrichterin ernannt und hat zahlreiche internationale ICC-, DIS- und Ad-hoc-Schiedsverfahren als Vorsitzende, Einzelschiedsrichterin oder Parteischiedsrichterin geführt.

Die Bundesregierung hat sie 2007 als eine von vier Schiedsrichtern des International Center for Investment Disputes (ICSID) berufen. Sie wurde kürzlich nach einem von der Bundesregierung organisierten Auswahlverfahren erneut für die ICSID-Schiedsrichterliste benannt.

Patricia ist außerdem als stellvertretendes Mitglied des Ernennungsausschusses der Deutschen Institution für Schiedsgerichtsbarkeit (DIS) benannt.

Publikationen

Patricia Nacimiento ist auch akademisch tätig und veröffentlicht regelmäßig. Sie ist Mitherausgeberin führender Handbücher zur Schiedsgerichtsbarkeit:" Arbitration in Germany – The Model Law in Practice" (Boeckstiegel, Kroell, Nacimiento (eds.) Kluwer 2nd ed 2015) und “Recognition and Enforcement of Foreign Arbitral Awards: A Global Commentary on the New York Convention" (Kronke, Nacimiento, Otto, Port Kluwer, 2010).
