Inclusion in an internal appeal panel of an individual who is junior to the decision-maker will not necessarily render an appeal process unfair, despite being contrary to Acas guidance. In Adeshina v St George's University Hospitals NHS Foundation Trust the appeal was not unfair as the junior individual was on a panel with two more senior managers and assisted by an independent expert.
